My divorce case [2007-2010] was before Magistrate Johnson. In 2008, I blew the whistle on Johnson and the divorce attorney not adhering to Porter County Local Court Rule 2100 [full disclosure of martial assets /Financial Declaration Forms]. No one was reprimanded on this matter. There was no investigation by the Court. My property settlement was vacated, due to non-adherence to Rule 2100.
Johnson in turn intentionally dragged my divorce case out another two years, and took this opportunity to retaliate against me [for having blown the whistle]. Court transcripts detail the suffering I was subjected to. In addition, Johnson refused to honor the personal protective order against my ex; ignored another court's arrest warrant for my ex's threat to kill me; continued to place me in danger; etc.
For instance, in the November 2008 court transcripts, I informed Johnson [during a hearing] that my ex had attempted to sexually assault me. Johnson asked my ex if it was true and my ex replied that it was. Johnson said nothing nor did nothing.
In April 2010, I contacted the Indiana Judiciary Commission regarding Johnson's refusal to issue a final property settlement. The Commission investigated and discovered that Johnson had failed to issue final rulings in more than 100 cases. During this investigation the Commission released my name to Johnson.
Magistrate Johnson was temporarily removed from the bench and given until October 01, 2010 to issue final rulings on all his divorce cases. During that time, he issued a final ruling on my case in which I would never receive my settlement: my ex was only obligated to pay me a settlement if and when he decided to sell the marital home. Under Johnson's order, I was to be put out on the street with nothing on October 7, 2010.
In August 2010, I filed complaints with the Commission regarding Johnson's two years of retaliation against me and his failure to protect me from my ex-husband / uphold the personal protective order. The Commission informed me that they were reviewing my complaints.
Also, in August, I had a hearing [which my ex and his attorney refused to attend] to request immediate distribution of my settlement. Johnson stated that he had to talk to my ex and his attorney before he would sign the order. Johnson later refused to sign the order. I sent the court transcripts from the hearing and the order to all the Porter County judges. It appears that Judge Julia Jent originally signed the order [as it the signature was whited out except for her lower 'J' hoops]. Judge Bradford's [Johnson's boss] rubber stamp signature was affixed over a portion of the original signature. The order was then signed by Johnson.
On October 7th, 2010: The local newspapers disclosed that Johnson had failed to issue rulings in all his cases, and the Judges would discuss the next step with Johnson in November; my ex was in contempt of the order to pay me my settlement [over $110,000]; and I was still residing in the marital home because I did not have the funds to vacate; AND that was the date officers from the Portage PD illegally entered my home.
Without a warrant, officers from the Portage Police Department, along with my ex [who still had a personal protective order against him plus a previous conviction for threatening to kill me] illegally entered my home. The police informed me that they had been told to criminally enforce the civil order that I was to vacate the martial home. The police refused to enforce any part of that same order in which my ex was to immediately me my settlement and which my ex was in contempt of.
Let me stop right there. A retired sheriff deputy was monitoring his scanner at home during this illegal police entry, and he overheard the Portage Police officers remarking about a very large sum of money my ex had. This was hidden marital assets. But why would the police officers know about this...and then refuse to enforce the part of the order that my ex was in contempt of? A Portage Police officer later told me that my ex had more than enough money on him that day, to pay me my entire settlement on the spot.
Before the police put me out on the street [without a penny], I called former Portage city attorney John Rhame and he talked with the officers. He told them to retreat. That they had no right to enforce a civil order as a criminal order. Rhame told them my ex could not be on the property because of the PPO. The officers refused to retreat. They also assisted my ex in removing items from the home and loading his pickup truck.
The officers gave my dogs to my ex, because they told me I was going to be homeless and I could not have my dogs. I told them my ex had abused my dogs and previously threatened to kill them. The officers laughed at me and told, “Only call us if they end up dead”.
I later contacted the Porter County judges. They refused to help me. Johnson was later placed back on the bench. My complaints against Johnson 'disappeared. My ex later had my beloved dogs killed.
I went to the Portage Mayor and the Police Chief. If anything I was intimidated and harassed.
In June of 2011, I contacted Attorney General Zoeller, Senator Lugar and Congressman Visclosky. I even allowed them to use my illegal police entry situation for their illegal police entry legislation. I believed that the illegal police entry into my home was retaliation on the part of Magistrate Johnson for me having reported him to the Commission. I do not know if they used my information for their legislation or not. What I do know is that Zoeller, Lugar, and Visclosky did not help me or investigate the illegal police entry or the deaths of my dogs.
Instead of being safe at home in Michigan, I am stuck here in Porter County Indiana without any police protection against my abusive ex, who had threatened to kill me and who has gotten away with killing my dogs.
How much danger am I in [due to me blowing the whistle on a Magistrate]? In April 2011, domestic violence victim Cynthia Cashner [whose divorce case was before Magistrate Johnson] was murdered by her ex-husband. Within 24 hours of Cynthia's murder, Portage Mayor Valesquez was on the phone with me...asking me how safe I felt and discussing who I was going to call if my ex came after me, since we both knew I couldn't call the Portage PD.
I have received no answers for what I was subjected to. I am expected to just 'accept it' as my 'punishment' for having blown the whistle on Magistrate Johnson.
I just thought you might want to know what is happening in Porter County...and what city, county, state and federal officials are ignoring.
