With their witnesses' memories fading and addresses changing, federal prosecutors say they are eager to begin the criminal case against politically connected Gary businessman Jewell Harris Sr.

But the timing of the case has hit a snag -- indicted Lake County political operative Robert Cantrell.

Cantrell and Harris share the same defense attorney, Kevin Milner, in their separate fraud cases.

But when U.S. District Judge Paul Cherry agreed to move the Harris case back to March 31, both sides objected because Cantrell's trial begins March 17 and is not expected to conclude in two weeks.

Prosecutors Bernard Van Wormer and Thomas Kirsch want Cherry to hold the Harris trial in January because it has been 18 months since the indictment was filed alleging Harris double-billed the city for hauling work at The Steel Yard baseball stadium in 2001.

"The government is faced with the problems of witnesses with fading memories or who have moved several times in the interim and are difficult to locate," the prosecutors wrote in court papers.

Milner has refused to represent Harris unless Cherry agrees to push the trial date until next May or later, saying no competent attorney would jump into such a case with such a limited timeline before the trial.

"One does have to wonder why the government is more interested in trying to keep me from representing Jewell than in building the case itself," Milner said Friday.

Cantrell, a longtime political power broker in East Chicago, was indicted on charges that he did not disclose his profits from a contract between his former employer, the North Township trustee's office, and political ally Nancy Fromm's counseling firm.

The Harris and Cantrell cases are entirely unrelated, except for Milner's representation of both defendants.

This was my provisional order hearing. I was requesting that my maintenance be increased and that I be given funds for my medical and dental care.

My ex was not present for this hearing. I had to sit in a mediation room with attorneys Rice and Shaw and plead my case for needing certain medical care [ pap smear; mamogram; hormone replacement therapy; bladder surgery; care for my Graves Disease;  dental care; etc.].

Rice and Shaw sat across the table from me judging whether I was worthy of certain medical care or not. In the end, they agreed that I would be given $500 towards medical and dental care. If it didn't cover all my costs, then I would have to go without.

Rice and Shaw shot down my request that my maintenance be raised from $100 a week. They told me that I was receiving more than I deserved. I would later discover that I had been entitled to $400 a week in maintenance.

During this meeting, I informed Rice and Shaw that my ex was not paying household expenses that he was court ordered to pay in September. Both attorneys chuckled and asked me why I was being so demanding.

Default hearing for immediate distribution of properrty settlement.

At this hearing, I requested that the court order my ex to pay me my property settlement in full before he was allowed to take possession of the house. Magistrate Johnson ignored this request. This would have put a halt to the October 7th unlawful police entry into my home.

This is a default hearing, thus the court should have honored this request in an order that my ex could not take possession of the marital home until after he paid me my property settlement. This puts more question on the unlawful police entry into my home on October 7th.

Magistrate Johnson's comment about wanting ex-parte' communication with my ex's attorney : "I'm disappointed that Mr. Shaw chose not to attend. I would be interested in his response..."
