09182008 - Court Order - Property settlement vacated - CAUSE NO: 64D01-0708-DR-7804/Porter County Superior Court, Valparaiso IN


This is where the retaliation began in my divorce case. After I exposed the fact that divorce attorneys were not adhering to Rule 2100, Magistrate Johnson subjected me to hell. He ignored the PPO as my ex's actions against me increased.  

He would also allow my ex to get away with whatever they wanted to do. Johnson never held my ex in contempt of the maintenance orders. It was a joke to Johnson, Attorney Shaw and my ex that they had me living without utilities, medical care, and basic necessities for the next two years. They made sure I paid for exposing Rule 2100...






Magistrate Johnson failed to report Attorneys Shaw and Rice's non-compliance with a Porter County Local Court Rule to the proper authorities. Likewise, there was never an investigation of other divorce cases handled by Rice and Shaw to insure that Rule 2100 was adhered to, and to correct this error.






Magistrate Johnson failed to report Attorney Shaw's discrepancies between his written order and the court transcripts to the proper authorities.








Magistrate Johnson failed to report Attorney Shaw and Attorney Rice for this ethic violation...







Magistrate Johnson failed to report attorneys Shaw and Rice for their failure to comply with mandatory discovery...








How many other divorces in Porter County needed to be vacated for this same reason? How many other divorces had attorneys Shaw and Rice mishandled in violation of Local Court Rules?







My ex and his attorney Jeffrey Shaw did not abide by this order. They would be in contempt of this order, a November 2008 order, and a  January 2009 order to produce my ex's financial declaration forms. My ex and his attorney did not produce his forms until May 2009. They were never held in contempt.




















09182008 - May 2008 property settlement vacated - Rule 2100 not adhered to - CAUSE NO: 64D01-0708-DR-7804/Porter County Superior Court, Valparaiso IN

Porter County Local Court Rule 2100 states that Financial Declaration forms must be filed in divorce cases. The Court and divorce attorneys [Attorney Jeffrey Shaw, Valparaiso IN; Attorney Donald Rice, Portage IN] failed to adhere to Rule 2100. My divorce property settlement was vacated for this reason.


There was no investigation into this matter by the Porter County Courts, to determine if the court / divorce attorneys had failed to adhere to Rule 2100 in other divorce cases. Instead, Magistrate Johnson retaliated against me and allowed my ex and his attorney to get away with whatever they wanted to during the next two years of the divorce...

Default hearing for immediate distribution of properrty settlement.

At this hearing, I requested that the court order my ex to pay me my property settlement in full before he was allowed to take possession of the house. Magistrate Johnson ignored this request. This would have put a halt to the October 7th unlawful police entry into my home.

This is a default hearing, thus the court should have honored this request in an order that my ex could not take possession of the marital home until after he paid me my property settlement. This puts more question on the unlawful police entry into my home on October 7th.
"Your Honor...It's not going to be safe for me around here..."

Magistrate Johnson's comment about wanting ex-parte' communication with my ex's attorney : "I'm disappointed that Mr. Shaw chose not to attend. I would be interested in his response..."
