08262010 - Magistrate Johnson Made Partial Ruling On 08192010 Hearing - Johnson Didn't Mail Order Out Until 09102010 - Divorce Case - CAUSE NO: 64D01-0708-DR-7804/Porter County Superior Court, Valparaiso IN
On August 21st, Magistrate Johnson issued the following order for the August 19th hearing, in regards to the 401K. However, Johnson had failed to sign the default hearing order for me to immediately collect my entire property settlement [before October 7th]....Although Attorney Rhame had written and submitted the August 19th order to Johnson the day after the hearing.
It is interesting that Johnson signed this order on August 21st...Yet did not file it until August 26th...And more interesting that he had not mailed this order until September 10th. This order was received September 13th, giving my attorney and me no time to obtain another court date prior to October 7th, for Johnson's signature on the August 19th order.
On September 22nd, I forwarded the August 19th order [that Johnson refused to sign] to all six Porter County judges.

08202010 - August court order submitted to Johnson [08192010 hearing] - Magistrate refused to sign - Divorce Case - CAUSE NO: 64D01-0708-DR-7804/Porter County Superior Court, Valparaiso IN
On August 20th, my attorney [John Rhame] submitted the order for the August 19th default order to Magistrate Johnson for his signature. This order would grant me immediate distribution of my settlement funds. Johnson failed to sign the order. Apparently, Johnson did not care if I did not receive my settlement from my ex.
The order was not signed until September 22nd, after I faxed the order to each of the Porter County judges.

Default hearing for immediate distribution of properrty settlement.
At this hearing, I requested that the court order my ex to pay me my property settlement in full before he was allowed to take possession of the house. Magistrate Johnson ignored this request. This would have put a halt to the October 7th unlawful police entry into my home.
"...If, you know, the court require that before he takes possession of the house, he buys out my interest..."

"Mr. Thomas is a very violent man. He's a very controlling man..."

This is a default hearing, thus the court should have honored this request in an order that my ex could not take possession of the marital home until after he paid me my property settlement. This puts more question on the unlawful police entry into my home on October 7th.
"Your Honor...It's not going to be safe for me around here..."
Magistrate Johnson's comment about wanting ex-parte' communication with my ex's attorney : "I'm disappointed that Mr. Shaw chose not to attend. I would be interested in his response..."
